It is illegal for a debt collector to threaten to garnish wages in order to force you to pay them.  It is a violation of Section 807 and 808 of the Fair Debt Collection Practices Act -  Meaning, you can sue the collection agency for violating the FDCPA.</description>

That generally means that (assuming you are in violation of your agreement, or not paying them back) they can sue you and then win a judgment.  After winning the judgment, then they can attempt to apply the judgment as a lien, levy, or even garnish your wages.

Frankly, most payday loan companies don&#039;t legally pursue delinquent debtors... because it is really expensive to hire attorneys and go through the process.  If you do get sued, or want specific advice, i&#039;d recommend hiring an attorney who is licensed in your state.
